Federal Constitutional Court hears initial arguments in super tax cases

The Federal Constitutional Court on Monday conducted the initial hearing in cases concerning the super tax, marking the first appearance of corporate lawyer Makhdoom Ali Khan before the bench.

A three-member panel, led by Chief Justice Amin-ud-Din, presided over the preliminary proceedings before adjourning for a short break. During the hearing, Makhdoom Ali Khan argued that the super tax, introduced in 2015 with an initial revenue target of Rs80 billion, had collected Rs114 billion from 2015 to 2022, with over Rs3 billion already spent.

He further claimed that the banking sector had been treated unfairly under the super tax framework.

After resuming, Makhdoom Ali Khan completed his arguments on Section 4B of the Income Tax Ordinance, while the court scheduled arguments on Section 4C for the following day.

FBR lawyers Asma Hamid and Shah Nawaz Memon responded during the hearing, presenting the federal government’s position. Towards the end of the session, Additional Attorney General Aamir Rehman was called to the bench. He stated that he would submit his observations after all lawyers had concluded their arguments, emphasizing that he was representing the federation.

The court adjourned the case until Wednesday, when FBR counsels are expected to begin arguments on Section 4C of the Income Tax Ordinance.
