SC hears Benazir Bhutto’s 1997 phone-tapping review plea against president Leghari

The Supreme Court’s constitutional bench heard the phone-tapping review petitions filed by former prime minister Benazir Bhutto and Yousaf Raza Gillani in 1996.

Justice Jamal Mandokhel emphasized that the outcome could impact several pending cases.

An additional attorney general outlined the 2013 law allowing phone tapping by ISI and IB under judicial oversight.

Justice Mazhar stated that the law did not permit just anyone to tap phones. Justice Mazhar inquired if a judge was appointed for phone-tapping approval.

The case was adjourned, with notices issued to advocate generals.

The case

On January 29, 1997, a seven-member bench of the Supreme Court of Pakistan upheld the dismissal of former prime minister Benazir Bhutto as chief executive and the dissolution of the federal cabinet and the National Assembly by the then president Sardar Farooq Khan Leghari on November 5, 1996.

Immediately after the above judgment, the petitioners, former Prime Minister Benazir Bhutto and Yousaf Raza Gilani, filed a review petition, which could not be heard for 28 years
